Notarization is the process by which a court-appointed notary public records a legal act or fact in a notarial deed, giving it strong evidentiary effect. In Taiwan, a civil notary public is appointed by the Judicial Yuan and attached to a District Court, so a notarized document carries the effect of a public document.
When do you need notarization?
- Lease and tenancy agreements
- Loan and repayment agreements
- Divorce settlement agreements
- Wills
- Powers of attorney
For certain agreements, the parties may agree that the document is directly enforceable. If a party later defaults, the other side can apply to the court for compulsory enforcement without first filing a lawsuit — saving considerable time and cost.
